Welcome to www.qaeverest.ai ("QAEverest", "we", "our", "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, platform, applications, public APIs, and related services (collectively, the "Services"). By accessing or using the Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Services. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Services Provided
QAEverest is an AI-assisted quality engineering platform. Our Services include, but are not limited to:
- AI Test Case Generation: Generation of test cases from user stories or requirements in BDD/Gherkin and traditional formats, including story refinement and quality scoring.
- UI / Web & Mobile Automation: AI-driven execution of automated tests against web and mobile applications, including AI locator resolution, self-healing, and self-maintaining test suites.
- API Automation: Generation and execution of API test suites with assertions and authentication handling.
- Performance Testing: Load, stress, spike, and soak testing.
- Security Testing: Header, SSL/TLS, and vulnerability scanning with AI analysis.
- Accessibility Testing: Automated WCAG compliance scanning with AI analysis.
- Visual Regression & Test Health: Visual comparison, flakiness detection, quarantine, and ROI analytics.
- Traceability: Requirement-to-test coverage matrices and AI gap analysis.
- Integrations: Connectivity with third-party tools such as Jira, Confluence, Azure DevOps, GitHub, GitLab, Bitbucket, Jenkins, ClickUp, and Slack.
- Public API & MCP Server: Programmatic access to the Services via API keys, including IDE-based test generation.
We use third-party AI providers, a payment gateway, and cloud storage to deliver these Services. The specific Services available to you depend on your subscription plan and the features enabled for your account or organisation.
Subscription Plans & Billing
- The Services are offered under various subscription plans (for example, Free, Basic, Standard, Advanced, and Enterprise), as well as separate API-client plans with per-call billing. Plan availability, pricing, included credits, and features are described on our pricing pages and may change from time to time.
- Paid plans are valid for the duration stated for the plan and may expire or renew in accordance with the plan terms. You are responsible for monitoring your plan's expiry and renewal.
- Enterprise and custom plans are subject to separately agreed commercial terms.
Organisations, Teams & User Roles
- The Services support multi-tenant organisation accounts. An organisation may have administrators who manage users, projects, integrations, and billing on behalf of the organisation.
- Users within an organisation may be assigned roles (such as admin, lead, member, and viewer), which determine the actions they may perform. Roles may also be assigned at the project level.
- Organisation administrators are responsible for the conduct of users they create or invite, for assigning appropriate roles, and for ensuring their users comply with these Terms.
User Responsibilities
Account Registration
- You must provide accurate and complete information when registering for an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to notify us immediately of any unauthorized use of your account.
Use of Services
- You agree to use the Services only for lawful purposes and in accordance with these Terms.
- You must not misuse the Services, including but not limited to engaging in illegal activities, infringing on the rights of others, attempting to gain unauthorized access, or disrupting the Services.
Authorization to Test & Acceptable Use of Automation
The Services can drive live browsers and send automated requests, load, and security scans against applications and URLs that you supply. Because these activities act on real systems, you specifically agree that:
- You will only run UI, API, performance, or security automation against applications, systems, or URLs that you own or are expressly authorized to test.
- You will not use the Services to access, attack, overload, disrupt, or perform denial-of-service or unauthorized penetration testing against any third-party system.
- You are solely responsible for obtaining all necessary permissions and for any consequences of running automation against the targets you specify.
- We may suspend or terminate access if we reasonably believe the Services are being used against unauthorized targets or in violation of this section.
AI Functionality & Output Disclaimer
- The Services use artificial intelligence to generate and process content, including test cases, locators, self-healing fixes, security and accessibility findings, coverage analysis, and exported automation code.
- AI-generated output is provided on an "as is" basis, may contain errors or omissions, and should be reviewed and validated by a qualified human before being relied upon. We do not warrant the accuracy, completeness, or fitness for any particular purpose of AI-generated output.
- You are responsible for how you use AI-generated output, including any code, test results, or recommendations.
Customer Application Data & Screenshots
- To deliver automation, self-maintaining suites, and visual features, the Services may load, crawl, screenshot, and record the applications and pages you direct them to.
- By using these features, you authorize us to capture and process such screenshots, page content, DOM data, and execution recordings, and you confirm you have the right to grant this authorization.
- This data may be transmitted to our AI providers for processing and stored as described in these Terms and our Privacy Policy.
Third-Party Integrations & Credentials
- The Services integrate with third-party tools such as Jira, Confluence, Azure DevOps, GitHub, GitLab, Bitbucket, Jenkins, ClickUp, and Slack.
- When you connect an integration, you authorize us to access that service on your behalf using the credentials, tokens, or API keys you provide, in order to read or write data such as issues, requirements, test cases, and pipeline triggers.
- You are responsible for the credentials you supply and for complying with the terms of each third-party service. Your use of any third-party service is governed by that service's own terms and privacy policy.
Public API, MCP Server & API Keys
- We may issue API keys that allow programmatic access to the Services, including via our public API and MCP server. API usage may be subject to rate limits, request quotas, and per-call billing.
- API keys are confidential. You are responsible for keeping them secure and for all activity performed using your keys. You must not share, resell, or expose your keys.
- We may revoke or rotate keys, or suspend API access, in cases of suspected misuse, abuse, or breach of these Terms.
Third-Party Providers
AI Providers
We use one or more third-party AI/LLM providers to deliver AI features. Depending on configuration, this may include providers such as Anthropic Claude (including vision models), Amazon Web Services (Bedrock), and other AI providers. To provide the requested Services, content such as user stories, requirements, test cases, DOM/HTML data, and screenshots of your applications may be transmitted to and processed by these providers.
Payment Gateway
We use a third-party payment gateway to process payments. Payment information is handled in accordance with the payment gateway's privacy policy and security measures.
Cloud Storage
We store data on third-party cloud storage and database services. Stored data may include profile information, user stories, generated content, test cases and suites, uploaded files and images, execution reports, screenshots, visual-regression baselines, execution recordings, and credentials or tokens you provide for integrations.
Enterprise: SSO, Audit Logs & Security
- For enterprise and organisation accounts, we may offer Single Sign-On (SSO/SAML), audit logging, and role-based access controls.
- Where SSO is enabled, user accounts may be provisioned based on assertions from your identity provider, and you are responsible for the accuracy of those assertions and for managing your identity provider configuration.
- We maintain reasonable administrative, technical, and organisational measures designed to protect your data. Specific security commitments, if any, are set out in your applicable enterprise agreement.
Government Laws, Payment Conversion Rate, and Tax Policy
Compliance with Laws
You agree to comply with all applicable local, state, national, and international laws and regulations.
Payment Conversion Rate
Plan amounts are denominated in USD and may be presented or charged in INR or other currencies. Conversion rates for foreign-currency payments are determined by our currency provider and/or the payment gateway at the time of the transaction.
Tax Policy
You are responsible for all taxes associated with your use of the Services, including any applicable sales tax, VAT, GST (for example, 18% GST for applicable Indian customers), or other taxes imposed by relevant authorities.
Credits, Refunds & Plan Expiry
Credit System
- Many Services consume credits on a per-operation basis (for example, test case generation, repository imports of existing automation scripts, UI and API automation runs, performance, security, and accessibility scans, story refinement, coverage analysis, and file or image uploads). Applicable credit costs are displayed within the platform and may be updated from time to time.
- Credits may be allocated to an individual account or to a shared organisation credit pool.
- Credits can only be used for the Services, have no cash value, are non-transferable, and expire upon the expiry of the associated plan or credit allocation. Expired credits are forfeited and are not refundable.
Refund Policy
- Refunds may be issued at our discretion and are subject to our review of the circumstances.

Data Retention & Deletion
We retain your data, including test data, reports, screenshots, recordings, and stored integration credentials, for as long as your account is active or as needed to provide the Services, and thereafter as required to comply with our legal obligations. Upon termination, we will delete or anonymise your data within a reasonable period, except where retention is required by law.
Intellectual Property & Licence
- The Services, including all software, models, designs, and content we provide (excluding your content), are owned by QAEverest or its licensors and are protected by intellectual property laws.
- You retain ownership of the content you submit (such as user stories, requirements, and test data). You grant us a licence to host, process, and transmit that content as necessary to provide the Services, including processing by our AI and third-party providers.
- Subject to your compliance with these Terms and payment of applicable fees, output generated for you (such as generated test cases and exported automation code) may be used by you for your internal business purposes.
Errors and Liability
Third-Party Errors
- We are not liable for errors caused by third-party services, including AI providers, the payment gateway, cloud storage, and connected integrations.
- If you encounter an error, please contact us at support@qaeverest.com, and we will work with the third party to resolve the issue.
Limitation of Liability
- Our liability is limited to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages arising from your use of the Services.
Service Availability
We aim to keep the Services available, but we do not guarantee uninterrupted or error-free operation. Execution agents, scheduled runs, and integrations may be unavailable due to maintenance, third-party outages, or other factors. Unless otherwise stated in a separate enterprise agreement, the Services are provided without a service-level guarantee.
Guidelines for User Story
To ensure quality and relevance, we have established some guidelines. If a story you submit for test case generation does not meet these guidelines, a small fee of 10 credits will be deducted from your account.
Error Occurs if:
- The story description is incomplete or unclear.
- The story contains irrelevant, prohibited activities or nonsensical information.
- The story exceeds the character limit.
Prohibited Activities:
Our platform does not support the creation of test cases that involve the following:
- Harmful or Explicit Content: Content promoting violence, hate speech, or pornography.
- Discrimination and Bias: Content promoting discrimination or bias based on race, gender, religion, or other protected characteristics.
- Misinformation and Manipulation: Content spreading false or misleading information, or manipulating users into taking undesired actions.
- Privacy and Security Violations: Content designed to breach user privacy, steal data, or compromise security systems.
- Intellectual Property Infringement: Content that infringes on copyrights, trademarks, or other intellectual property rights.
- Exploiting Vulnerable Populations: Content targeting or exploiting vulnerable populations, such as children or the elderly.
- Unethical AI Development: Content promoting or facilitating the development or use of unethical AI practices.
- Malicious Software: Content designed to create or distribute malware, viruses, or other harmful software.
- Promoting Unethical Conduct: Content encouraging illegal, immoral, or harmful behaviour.
- Army Confidentiality: Content that violates military regulations or compromises sensitive information.
- Restricted Information: Content related to classified or restricted information that you are not authorized to handle.
Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of , and any disputes will be subject to the exclusive jurisdiction of the courts of .
Changes to Terms
We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
